This document is not meant to be for registering, it stays in electronic format. It is not classified as a written contract, it is written in Hungarian, and not point to at any behaviour codes. If you have questions about the operation of the webshop and your order process, we will be at the given contact details.

  1. Basic provisons

 

  • The governing law is the hungarian law, especially the Civil Codex (2013.V.), the electronic commercial code (2001.CVIII.), and the sumptuary law (45/2014 (II.26.) for the interpretation and by this „general terms and conditions” not ruled question. The obligatory parts of the mentioned rules are authoritative without any other clause.

 

  • These Articles are effective law since 21st April and remaining in force until revocation. The provider can modify individually these Articles. The modifications need to be issued 11 (eleven) days before the effective date by the Provider.

With using the webpage Users/Customers accept automatically all the terms and conditions in connection with using the webpage.

 

  • The user acknowledges general terms and conditions compulsory as soon as a user log in the website –run by the Provider- or read its content. If the user does not accept terms and conditions does not have right to reach the content of the website.

 

  • The Provider reserves all rights in connection with the content and dissemination of the website and webpage. It is absolutely forbidden to download, (electronic) store, process, or sell Any content published in the website or part of them without written consent of the Provider.

 

  1. Registration/Purchase

 

  • The User/Customer declares to accept this general terms and conditions, and to get to know the condition of the Data Management Document, and agree with that, while shopping/registrating on the webpage.

 

  • The User/Customer is liable to give its real, own data during shopping/registration. The electronic contract with unreal or third person’s data is absolutely void. The Provider excludes the accountability if the User/Customer uses third person’s name, data while utilizing the service.

 

  • The Provider does not take liability for delivery default, any other problems or mistakes because of misguided or inaccurate information.

 

  • Service Provider takes no responsibility for any loss caused by that the User forgot his/her password or it became accessible to unauthorized persons as a result of any reason for which the Service Provider cannot be responsible.

 

  1. Available products and softwares

 

  • Displayed products can only be ordered online. The prices shown on the products are in HUF, they include the statutory VAT, but do not include the home delivery fee. No extra packaging fee will be charged.

 

  • In the web shop, the Service Provider details the name, description and product of the product. Images displayed on a product datasheet may differ from reality, as an illustration. We are not responsible for the difference between the image displayed in the webshop and the actual appearance of the product.

 

 

  • If there is a product on sale available, the Provider informs users/customers about the sale and its length of time.

 

  • If there is wrong price shown in the Webshop – in spite of due diligence of the Provider- it is not required from the Provider to deliver for the wrong price but for the right price. Especially with regard of significantly divergent. For example: „0” HUF or „1” HUF because of a system error. The users/ customers can abandon the shopping.

 

  • In case of false price, there is an onerous contract between the real and the visualized price of the product. A costumer should recognize that. According to the Civil Codex (PTK. 2013. V.)the animus of clients must be concordant, and synallagmatic. If clients can not make a compromise, and there is not any concordant and synallagmatic animus’, there is not any binding agreements, which constitute a binding contract. According to these facts, the contract is void, if the acknowledgement of order based on the wrong/false price.

 

  1. Process of ordering

 

  • After the registration you will be able to sign in to the webshop / or you can start shopping without registration.

 

  • The user sets the number of the product/products to buy.

 

  • The user places the selected products in the basket. Users can view the basket content at any time by clicking the "basket" icon.

 

  • If you want to add more items to your basket, select the "Continue Shopping" button. If you do not want to buy more products, check the number of products you want to buy. Click on the "delete - X" icon to clear the contents of the basket. To finalize the quantity, click the "Update / Update Basket" icon User.

 

  • The user selects the delivery address and then the delivery / payment method, which types are as follows:

 

  • Payment methods:

 

Payment by cashback: If the ordered product is delivered by courier service, it is possible for the User to complete the order amount to the courier in cash upon receipt of the ordered product (s).

 

By transfer: The user must transfer the value of the ordered products to KOVPEZO Kft's account number 10401024-50526554-65511006 with K & H bank. After the amount is credited to the Service Provider's bank account, the User is entitled to receive the product (s) in a manner determined by it.

 

Payment with PayPal: The process of purchasing with PayPal:

The details of the transaction appears on the left side of the website, and the two choice opportunity on the right side of the website:

 

  1. If you have Paypal account, after you have given your valid identity and password, you can see part of the pre-given bank card informations and the payable price. If more than one bank card were given, then you have to choose the one you want to pay with. After that you have to click on the Pay Now sign. When the payment is finished the website returns you to the webshop’s homepage.
  2. If you don’t have Paypal account, then you have the opportunity to fill a form and pay with a Guest Paypal access, without any need of a registration in the Paypal’s system. The form needs the following informations (most of them are required to fill in):

If you filled all of the fields, click on the „Review and Continue” button ont he bottom of the page. There you can check again the given data, the amount to be paid and the order. If you agree with everything, approve the trasaction. In a few seconds, you should get an e-mail about the succeded transaction and the Service Provider gets the notification about the payment too, and starts the process the order.

  • If there is lack or imperfection in connection with the products or prices in the webshop, we reserve the rights for correction. In such a case we inform the customer about the new data immediately after the recognition or modification. Afterwards, the customer can confirm the order again, or has a chance to rescind the contract.

 

  • The total sum contains all the charges according to the totalizing of the order and the letter of confirmation. The bill is included in the package. The user is obliged to check the package at delivery before the courier and in case of possible damage to products or packaging, he or she is obliged to request a record and in case of damage the package is not obliged to take over. Subsequent, non-recorded complaint by the Service Provider does not accept it! Packages are delivered on business days between 8 am and 5 pm.

 

  • Once you have entered the data, you can submit your order by clicking on the "Confirm Payment" button, but you can check the details provided before you can, or send a comment to your order or email us any other ordering wishes.

 

  • Correcting Input Bugs: A user can step back to the previous phase before completing the order process, where he can correct the input data.

 

  • The user/customer gets an email of confirmation after sending the order, which does not give rise to contract. If this e-mail does not arrive within an expectable deadline –depending on the profile of the service- or at latest within 48 hours, the user is relived of the bid fixity or contractual duty. The order and the confirmation of the order can be considered „arrived” to the Provider or to the User, when it is reachable for them. The Provider excludes the blame of confirmation, if the confirmation does not arrive in time because the user/customer has given wrong email address, or the storage pool of the account is full, and can not receive messages.

 

  • The User acknowledges that the confirmation in the previous section is only an automatic confirmation, and does not constitute a contract. The contract is created when the Service Provider notifies the User of the details of the order and its expected fulfillment after another automatic confirmation of the above mentioned item.

 

  1. Order processing and fulfilment

 

  • Orders are processed during opening hours. In addition to the times specified for processing the order, it is possible to place the order, if it is after the expiration of the working time, processing the next day. Service Provider's customer service will always confirm by electronic means when it can fulfill its order.

 

  • General Completion Deadline: Within 2 business days after the confirmation.

 

  • According to the contract of sale, the Service Provider shall transfer the ownership of the property, the User shall pay the purchase price and take over the thing.

 

  • If the seller is an enterprise and the buyer is a consumer and the seller undertakes to deliver the thing to the buyer, the risk of damage passes to the buyer when the buyer or the third party he designates takes possession of it.

 

  • If the seller is an enterprise, and the buyer is a consumer, for lack of distinct agreement of the signatories, the seller (based on this GCTC: Service Provider) is obligated to make available the product for the Customer (User), right after the conclusion of the contract, but in less than 30 days.

 

  • In case of late of the Service Provider the User is rightful to set an accidental deadline. The Customer is rightful to desist from the contract, if the seller can not accomplish in the accidental deadline.

 

  • The User is rightful to desist from the contract without accidental deadline, if:
  1. the Service Provider denied the fulfillment of the contract; or
  2. the contract should have been accomplished until the original deadline - not in another time - as agreed by the signatories.

 

  • In case the Service Provider cannot accomplish the contractual obligation because the product/or its component were not available, the Service Provider is obligated to inform the Customer right away and to pay back the sum paid by the Customer at once.

 

  • The Service Provider shall not be liable for any technical specifications or descriptions that may be due to the supplier without notice or for reasons beyond its control. The Service Provider reserves the right to refuse all orders already acknowledged in whole or in part. Partial fulfillment can only take place after consultation with the User!

 

  1. Waiver clause

 

  • According to the directive 2011/83/ EU of the European Parliament and Commission, further about rules of contracts between customers and enterprises (Gov. Degree 45/2014) (II.26), the user can rescind in 14 days from the date of delivery, can return the ordered product(s) and no grounds need to be alleged. Without this information users can exercise the cancellation right for 1 year. If the Service Provider gives the information not later than 14 days after receipt of the product or the date of conclusion of the contract but within 12 months, then the deadline for withdrawal shall be 14 days from the date of that communication.

 

  • The period for exercising the right of withdrawal shall expire 14 days after the date on which the consumer or a third party other than the carrier designated by the consumer gets the product.

 

  • The customer can exercise the waiver clause between the time of entering in a contract and the reception.

 

  • The cost of returning the product must be borne by the consumer, and the firm has not undertaken to bear this cost.

 

  • In the event that the right of withdrawal is exercised, consumers will not be charged other than the cost of returning the product, however, the Service Provider may claim reimbursement of material damage caused by improper use.

 

  • Withdrawing is not the customers legal due in case of not pre-produced product, which was made according to the instructions of the customer or according to the wish of the customer, or in case of such product, which is individualized.

 

  • The consumer may also not exercise his right of withdrawal in respect:

 

  1. in the case of a service contract, after completing the service as a whole, if the undertaking commenced the fulfilment with the prior consent of the consumer and the consumer has acknowledged that he will lose his right of cancellation after completing the service.

 

  • The Provider has to refund the expenses of the customer inclusive the delivery cost, immediately after return the products or arrival the confirmation of cancellation, but within 14 days.

 

  • In case of returning the costs, the same method of payment should be used, except the customer agree to another method of payment. The customer does not have any extra expense in connection with returning.

 

  • The Customer has to return or leave on the address of the Provider the products without any undue delay, but not later than 14 days, counting from the day of notification of confirmation the cancellation to the Provider.

 

  • In case of cancellation by the consumer in writing, it is sufficient to send the withdrawal statement within 14 days.

 

  • The Customer meet the deadline of returning, if the customer returns or send back the products within 14 days.

 

  • The consumer shall only bear the direct cost of returning the product, unless the enterprise has undertaken to bear this cost.

 

  • The Provider does not have to repay the extra cost to the Customer, if the customers choose a different delivery method, but not the cheapest delivery method.

 

  • The consumer shall only be liable for the depreciation resulting from use beyond the use required to establish the nature, properties and operation of the product.

 

  • Refunds may be withheld by the Service Provider until it has received the Goods (s) or has not provided Customer with proof that they have returned them: the previous date must be taken into account.

 

  • In case the Customer would like to desist from the contract he/she can send notification by any of the methods given by the Service Provider in writing (using the attached form), or on telephone. In the case of writing notice sent by post the date of stage stamps is considered. In the case of telephone noticing the date of telephone notice is used. In the case of post notice registered postage or package are accepted by the Service Provider. Customer can return the ordered product to the Service Provider by either post or via a courier service.

 

  • Customer has to pay special attention to the proper use of the product because for damage caused by the non proper use of the product the Customer is responsible! Price of the product together with the delivery fee are refunded by the Service Provider to the Customer to the bank account given by the Customer within fourteen days of the arrival of the returned product.

  • The customers can look up the Provider with claims using the here obtainable contacts.

 

  • The right of cancellation is only entitled to the customers that are qualified as Users by the Civil Code.

 

  • Right of desist is not due to the company i.e. to the person who acts for his/her profession, occupation or business activity.

 

  • The Procedure of enforcing the right of desist:

 

  • If the Customer wishes to enforce the right of desist, then he/she needs to send the declaration about the intention of her/his desist to one of the contact details of the Service Provider.

 

  • The Customer enforces her/his right of desist on time, when she/he send the declaration of desist in 14 days, after she/he got the product. She/He only needs to send the declaration of desist in 14 days, if the customer wants to desist in writing. If the Customer would point out her/his desist by post, the date of posting is taken into account. If the Customer would point out her/his desist in e-mail or by telefax, the date of dispatching is taken into account.

 

  • The Customer is obligated to send back forthwith the product to the address of the Service Provider, but in in less than 14 days, counted from the sharing of the declaration of desist. The Customer only needs to send in less than 14 days, the product does not need to arrive in 14 days. This way the deadline is enforced. The client needs to pay any cost, which is in connection with the return.

 

  • The Service Provider is not obligated to pay back the additional costs for the Customer, if the Customer chooses a different transport mode, not the usual and cheapest mode, what was chosen by the Service Provider. The Customer can enforce her/his right of desist between the day of the contract and the day of the receipt of the product too.

 

  • In case of buying multiple products and the delivery of the products is not on the same day or the ordered products are delivered in multiple parts, the right of desist can be enforced in 14 days, counted from the last product or part.

 

  1. Warranties and guarantee

 

Failure

 

The bounded party fails, if the service is not according to the contract or to the qualities specified by the law at the time of the accomplishment. The bounded party does not fail, if the entitled party knew the fault in the time of the contract or she/he should have known the fault in the time of the contract.

The term, in the contract between the customer and the company, which is about the warranty that goods are of a specified quality and about the guarantee, is invalid, if this term is at the expense of the Customer.

 

Guarantee of requisites

 

  • In what kind of situation can the Customer exercise its right for guarantee of requisites?

 

The Customer (User) can exercise the guarantee of requisites against the enterprise, in case of not proper fulfilment according to the rules of Civil Codex.

 

  • What kind of rights are the customers legal due according to the guarantee of requisites?

 

The Customer can choose between the opportunities according to guarantee of requisites:

  • repair or exchange, except it is impossible for the Customer, or it is onerous cost for the enterprise
  • in case of no demand for repair, or exchange, proportional reduction of consideration is demandable, or the failure can be repaired for the cost of the enterprise by the Costumer or third person, or denounce the treaty
  • The customer can turn to an other guarantee of requisites, from the previously choice. The customer bears the cost of this process, except it was justified, or the enterprise gave ground to the turn.

 

  • What is the deadline for the customer of exercising the guarantee of requisites?

 

The customer is liable to announce the mistake immediately after recognition, but within 2 month after recognition. After the time of limitation -2 years counting back from the fulfilment of the contract- guarantee of requisites can not be asserted. In connection with diet-supplements, energy-drinks etc. the guarantee of requisites can be exercised in the „best before” period.

 

  • Who is enforceable in connection with the guarantee of requisites against?

 

Customers can enforce guarantee of requisites against the Enterprise.

 

  • What kind of other conditions have of enforce the guarantee of requisites?

 

Within 6 month after fulfilling the contract, there is not any more conditions to enforce guarantee of requisites, but the announcement of the mistake, if the customer depose the product or the service has been given by the webshop run by the enterprise. After 6 month after fulfilling the contract, the customer is liable to prove, that the mistake has been existed at the time of fulfilling.

 

 

Product warranty

 

  • In what kind of situation can exercise the Customer its right for product warranty?

 

In case of mistake of the mobiliary (product), the user can exercise the right of the product warranty or guarantee of requisites.

 

  • What kind of rights are the customers legal due according to the product warranty?

 

The Customer can ask just for repair or replace of the broken product.

 

 

  • In what kind of case is qualified the product „broken”?

 

The product is broken, if it is not fit to the quality requirement at the time of placing on the market, or the product does not have the attributes, which are listed in the description of the producer.

 

  • What is the deadline for the customer of exercising the product warranty?

 

The product warranty can be enforced by the Customer within 2 years from the time of placing on the market.  The right for exercising the product warranty is lost after this deadline.

 

  • Who is enforceable in connection with product warranty, and what kind of other conditions should be existed for enforcing?

 

The product warranty can just be set up against the producer or distributor. The mistake of the product should be proved by the Customer.

 

  • In what kind of case is the producer (distributor) relived of product warranty?

 

The producer (distributor) is relived of warranty, if it is proved:

  • the product has not been produced during business activity, or placed in the market
  • the mistake was not knowable at the time of placing in the market according to the science and technic
  • the mistake of the product is accused by adoption of officially rules

The producer (distributor) has to prove data enough to the relive.

Because of the same mistake relived of warranty and guarantee of requisites can not be enforced in the same time, collateral. After a successful enforcement of relived of warranty, guarantee of requisites can be enforced to the exchanged product against the producer.

 

Guarantee

 

  • In what cases can the Customer enforce quality warranty rights?

 

In the case of fault in the accomplishment of the contract the company operating the webshop is obligated to guarantee based on the Government Decree 151/2003 (IX. 22.) on the compulsory guarantee on consumer durables.

 

  • What right sin what time limits are due to the Customer based on guarantee?

 

The warranty period is one year. The warranty period is the transfer of the consumer goods to the consumer or when the product is put into service by the distributor or his authorized representative, commencing with the date of commissioning.

 

On the basis of your warranty claim, according to your choice

 

  1. unless the fulfillment of the chosen warranty is impossible or if the debtor would result in a disproportionate additional cost in comparison with the fulfillment of another warranty claim taking into account the value of the service in error, the breach of contract and the right of the holder interest; or

 

  1. it may request a proportionate reduction of the remuneration, may correct the error at the debtor's expense or repair the contract or cancel the contract if the debtor has not made the correction or replacement, can not fulfill this obligation (...) or if the interest of the entitled party in correcting or replacing has ceased.

 

There is no place for a withdrawal due to an insignificant error.

 

Correction or replacement should be carried out within a reasonable time, taking into account the nature of the matter and its intended purpose by the rightholder.

 

  • In what cases is the Company exempted from guarantee obligations?

 

Company is exempted from the guarantee obligations only if it can prove that the fault was caused after the accomplishment of the contract. It is worth noting that quality warranty and guarantee claims and product warranty and guarantee claims cannot be enforced simultaneously for the same fault. Guarantee rights of the Customer, however, apply to the Customer independent of product and quality warranty rights.

 

  • In the case of products, included in the Regulation based on the Government Decree 151/2003 (IX. 22.) on the compulsory guarantee on consumer durables, if the Customer enforces the replacement of the product, because of the failure of the product in 3 days from the purchase (placing in service), the company (webshop) can not reference on disproportionate additional costs because of the a) point of 2nd paragraph of Act V. of 2013 on the Civil Code (Ptk. 6:159. ), but the company is obligated to change the product, if the failure is against the proper usage.

 

  • Service Provider has no guarantee and warranty obligations for damages caused by natural wearing of the product and for damages caused by erroneous or careless handling of the product after the transmission of the hazard or by overuse and other effects and non proper use of the product.

 

  1. Procedure in case of right of guaranty

 

  • In the contract of the customer and the enterprise, the agreement cannot depart to the disadvantage of the customer.

 

  • The Proof of contracting is the duty of the customer (by bill, or sales check)

 

  • The Provider is responsible for costs in connection with the fulfilment of warranty. (PTK. 6:6166§)

 

  • The Provider need to write a record about requirement of the guarantee and warranty of the customer.

 

  • The copy of the record should be send immediately, ascertainable to the customer.

 

  • If the Provider can not make a statement about enforceability of requirement of warranty or guaranty, the Provider should inform about the reason of rejection, and about the opportunity of turning to conciliation committee. The Provider is liable to inform the customer in 5 days.

 

  • The Provider need to keep the record for 3 years counting from the time of recording, and has to shown for the ask of control comm

 

  • The Provider need to aim for complete the repair or replace within 15 days.

 

  1. Mixed regulation

 

  • The provider has a right to impress a contributor to fulfill its liability. The Provider has the full amenableness because of the illegal acts of the contributor, as the Provider made the illegal act.

 

  • In case any part of this articles became void, illegal or unenforceable, it does not concern the other part of the articles.

 

  • If the Provider does not exercise the right according to this act, it can not mean adjuration. Any adjuration is just rightful with the special written declaration. If the Provider does not make stand for its cardinal right, or reserval for one time, does not mean adjuration.

 

  • The Provider and the Customer try to arrange case out of court.

 

  1.  Adjustment of complaints

 

  • The purpose of our shop is to fufill all the orders in good quality, for the satisfaction of the customer. If the customer has any plaint in connection of the contract or fulfillment of the contract, the plaint can be reported per telephone, e-mail or letter.

 

  • The Provider checks the claim immediately, and repair that. If the customer does not agree with the repair of the claim, or the check is not possible immediately, the Provider take a record immediately about the claim and the point of view. The customer get a copy as well.

 

  • The written claim will be answered in 30 days. In case of dismission, the Provider give a reasoned statement. The Service Provider keeps the record and the copy of the record for 5 years and in case the Provider gives it for the control board.

 

  • We inform you, in case of the claim got declined, customers can apply for relief to the conciliatory proceeding with the following contacts:

 

  • In the case of a complaint the Customer may calls for the consumer protection authority:

  • Reconciliation Boards take care of dispute of the consumers if it is not handled in judicial way. The aim of Reconciliation Boards is to make an agreement between the parties in order to settle the dispute of the consumers, but if it fails, they make a simple, effective and cost-effective decision to enforce the rights of the consumers. The Reconciliation Board gives advice at the request of the consumer or the Service Provider in connection with the rights of the consumer and the obligations of the consumer.

 

  • In case of online trading or cross-border dispute of consumers in connection with online service contracts, only the Reconciliation Board is assignee, which is working next to the Chamber commerce in Budapest.

Because of that the Service Provider needs to send answer to the Reconciliation Board and needs to have a person who is entitled to make an agreement on the audition. If the headquarter of the company is not registered in the county known by the chamber which is operating the regional reconciliation board, the obligation of the company in the co-operation is to offer the possibility of the written agreement based on the demands of the consumer.

 

  • If the consumer does not turn to a conciliation body or the procedure has not succeeded, the consumer has the right to seek a court to settle the dispute. The lawsuit must be filed with a letter of formal notice containing the following information:
  • the court of law;
  • the names of the parties and representatives of the parties, their place of residence and legal status;

  1. If you have question during using some of the services of the data processor, or the customer has some problem you can get in contact with the data processer on the website (on phone, e-mail, community sites, etc.).

 

  1. The data processer deletes the incoming e-mails, messages, on phone, on any community site, etc. what contains the name and e-mail address or any other given personal information of the customer, after 2 years from the start of the service.

 

  1. We give information about the privacy policy which is not in this guide at the start of the service.

 

  1. For exceptional magisterial request, or in case of law accumulation the service provider is bound for guidance, information providing, transferring, or making documents available for these organisation.

  1. The right of access

 

You are entitled to receive feedback from the data controller about whether your personal data is being processed and, if such processing is in progress, you have the right to have access to your personal information and the information listed in the decree.

 

  1. The right of rectification

 

You are entitled to request the data controller to rectify any inaccurate personal information that he or she is required to do without undue delay. Taking into account the purpose of data management, you are entitled to request the supplementation of incomplete personal data, including by means of a supplementary statement.

 

  1. The right to cancel

 

You are entitled to request that the data controller, without undue delay, disclose personal information about you, and that the data controller is obliged to delete personal information about you, without undue delay, under certain conditions.

 

  1. The right to be forgiven

 

If the data controller has disclosed the personal data and is required to cancel it, taking reasonable steps, including technical measures, to take into account the cost of available technology and implementation, in order to inform the data controllers handling the data that you have applied for the personal data in question pointing links or deleting a duplicate or duplicate of these personal data.

You are entitled to request that your data controller restricts your data handling if one of the following conditions is met:

  • The data controller no longer needs personal data for data processing, but you require them to submit, enforce, or protect legal claims;
  • You have objected to data manipulation; in this case, the restriction applies to the period when it is established that the legitimate reasons for the data controller have priority over your legitimate reasons.

You are entitled to receive personal data that is made available to you by a data controller in a fragmented, widely used machine-readable format and is entitled to transfer this data to another data controller without this being obstructed by the data controller whose provided personal information to you (...)

You are entitled to object to the handling of your personal information (...), including profiling based on these provisions, for any reason relating to your own situation.

 

  1. Protest in case of direct business acquisition

 

If your personal data is handled for direct business, you are entitled to protest at any time against the handling of personal data relating to it, including profiling, if it is related to direct business acquisition. If you object to personal data being handled for direct business purposes, your personal information can no longer be handled for that purpose.

 

  1. Automated decision-making in individual cases, including profiling

 

You are entitled to exclude the scope of any decision based solely on automated data handling, including profiling, which would have a bearing on it or affect it significantly.

The preceding paragraph shall not apply if the decision is:

  • You are required to conclude or complete a contract between you and the data controller;
  • the granting of the right to a data controller is subject to the law of the Union or of the Member States which also lays down appropriate measures to protect your rights and freedoms and legitimate interests; or
  • you are based on your explicit consent.

 

Deadline for action

 

The data controller informs you of any measures taken in response to these requests without undue delay but in any way within 1 month of receipt of the request.

 

If necessary, it may be extended by 2 months. The controller will inform you about the extension of the deadline by indicating the cause of the delay within 1 month of receipt of the request.

 

If the data controller fails to take action upon your request, he or she will notify you without delay and at the latest within one month of the receipt of the request for reasons of non-action and whether you may file a complaint with a supervisory authority and exercise its right of appeal.

 

 

 

 

Security of data management

 

The data controller and the data processor shall take appropriate technical and organizational measures to take into account the state of science and technology and the costs of implementation, the nature, scope, circumstances and objectives of data management and the risk of varying probability and severity of natural persons' rights and freedoms to guarantee an adequate level of data security, including, inter alia, where appropriate:

 

  1. a) the pseudonymization and encryption of personal data;

 

(b) ensuring, maintaining, integrity, availability and resilience of the continuing confidentiality of systems and services used to manage personal data;

 

(c) in the case of a physical or technical incident, the ability to restore access to personal data and the availability of data in good time;

 

(d) the procedure for systematic testing, assessment and evaluation of the effectiveness of technical and organizational measures taken to ensure the security of data processing.

If the privacy incident is likely to pose a high risk to the rights and freedoms of natural persons, the data controller shall inform the data subject of the privacy incident without undue delay.

 

Information given to the data subject should be clearly and easily understood and the nature of the privacy incident must be disclosed and the name and contact details of the Data Protection Officer or other contact person providing additional information should be disclosed; the likely consequences of a data protection incident should be described; describe measures taken or planned by the data controller to remedy a data protection incident, including, where appropriate, measures to mitigate any adverse consequences of a data protection incident.

 

The person concerned shall not be informed if any of the following conditions are met:

  • the data controller has implemented appropriate technical and organizational protection measures and applied these measures to the data covered by the data protection incident, in particular the measures, such as the use of encryption, which make it impossible for persons who are unauthorized to access personal data the data;
  • after the data protection incident, the data controller has taken further measures to ensure that high risk for the rights and freedoms of the person concerned is no longer likely to be realized;
  • Informing would require disproportionate efforts. In such cases, the data subject shall be informed by means of publicly disclosed information or a similar measure shall be taken to ensure that such information is equally effective.

 

If the data controller has not yet notified the data subject of the data protection incident, the supervisory authority may, after considering whether the privacy incident is likely to pose a high risk, may inform the data subject.

The data protection incident shall be reported to the supervisory authority under Article 55 without undue delay and, if possible, no later than 72 hours after the data protection incident becomes known, unless the data protection incident is unlikely to pose a risk to the rights of natural persons and freedom. If the notification is not filed within 72 hours, the reasons for proving the delay must also be enclosed.

Im Falle der Verarbeitung personenbezogener Daten, die auf der Zustimmung der
betroffenen Personen basiert, für die Zwecke der Versendung von Geschäftsmitteilungen
sowie anderer Aktivitäten des Direktmarketings des Internethändlers.
Schutz personenbezogener Daten
1. IDENTITÄT UND KONTAKTDATEN DES VERANTWORTLICHEN
1.1. Verantwortlicher für Ihre personenbezogenen Daten ist die Firma
Bohemiasoft s.r.o., Rudolfovská tř. 247/85, CZ-370 01 České Budějovice,
Tschechien, ID-Nummer: 28090403, eingetragen im Handelsregister des
Bezirksgerichts České Budějovice, Abteilung C, Einlage 16675 (im Weiteren
nur „Verantwortlicher“).

2. GESETZLICHER GRUND FÜR DIE VERARBEITUNG PERSONENBEZOGENER
DATEN
2.1. Gesetzlicher Grund für die Verarbeitung Ihrer personenbezogenen Daten ist
Ihre Zustimmung, die Sie hiermit dem Verantwortlichen im Sinne von Art. 6
Abs. 1 Buchst. a) der Verordnung (EU) 2016/679 des Europäischen
Parlaments und des Rates zum Schutz natürlicher Personen bei der
Verarbeitung personenbezogener Daten, zum freien Datenverkehr und zur
Aufhebung der Richtlinie 95/46/EG (Datenschutz-Grundverordnung) (im
Weiteren nur „Verordnung“) geben.
3. ZWECK DER VERARBEITUNG PERSONENBEZOGENER DATEN
3.1. Zweck der Verarbeitung Ihrer personenbezogenen Daten sind die
Versendung von Rechnungen für die Vermietung des Systems, die
Versendung von Geschäftsmitteilungen sowie andere Marketingaktivitäten
des Verantwortlichen gegenüber Ihrer Person.
3.2. Seitens des Verantwortlichen erfolgen keine automatisierten individuellen
Entscheidungen im Sinne von Art. 22 der Verordnung.
4. SPEICHERUNGSZEITRAUM DER PERSÖNLICHEN DATEN
4.1. Ihre personenbezogenen Daten werden für einen Zeitraum von 3 Jahren
gespeichert, längstens jedoch bis zum Widerruf Ihrer Zustimmung zur
Verarbeitung personenbezogener Daten (für diesen Verarbeitungszweck).
5. WEITERE EMPFÄNGER DER PERSÖNLICHEN DATEN
5.1. Weitere Empfänger Ihrer personenbezogenen Daten sind die Firma Monekon
s.r.o. (zum Zweck der Verarbeitung der Rechnungsdaten), die Firma The
Rocket Science Group (zum Zweck der Zusendung von Newsletters über den
Service Mailchimp.com), die Firma Unihost s.r.o. (Verwalter der Server) und
die Firma Casablanca INT (Betreiber des Datenzentrums).
6. RECHTE DER BETROFFENEN PERSONEN
6.1. Unter den in der Verordnung festgelegten Voraussetzungen haben Sie das
Recht, vom Verantwortlichen den Zugang zu Ihren personenbezogenen
Daten zu verlangen, das Recht auf Berichtigung oder Löschung Ihrer
personenbezogenen Daten bzw. auf eine Beschränkung ihrer Verarbeitung,
das Recht auf Einspruch gegen die Verarbeitung Ihrer Daten sowie das Recht
auf Übertragbarkeit Ihrer personenbezogenen Daten.
6.2. Sie haben das Recht, jederzeit Ihre Zustimmung zur Verarbeitung Ihrer
personenbezogenen Daten zu widerrufen, die Sie dem Verantwortlichen
gegeben haben. Hierdurch bleibt jedoch die Gesetzmäßigkeit der
Verarbeitung Ihrer personenbezogenen Daten vor diesem Widerruf Ihrer
Zustimmung unberührt. Ihre Zustimmung zur Verarbeitung
personenbezogener Daten können Sie per E-Mail an info@bohemiasoft.cz
widerrufen.
6.3. Sofern Sie der Ansicht sind, dass durch die Verarbeitung Ihrer
personenbezogenen Daten die Verordnung verletzt wurde oder wird, haben
Sie unter anderem das Recht, eine Beschwerde bei der Aufsichtsbehörde
einzureichen.
6.4. Sie sind nicht zur Gewährung Ihrer personenbezogenen Daten verpflichtet.
Die Gewährung Ihrer personenbezogenen Daten ist kein gesetzliches oder
vertragliches Erfordernis und auch nicht erforderlich für den Abschluss des
Vertrags.
Verarbeitungsvertrag
1. IDENTITÄT UND KONTAKTDATEN DES AUFTRAGSVERARBEITERS
1.1. Der Auftragnehmer (Bohemiasoft s.r.o.) ist in Bezug auf die
personenbezogenen Daten der Kunden des Nutzers, als der Käufer in den
E-Shops des Nutzers, Auftragsverarbeiter nach Art. 28 DSGVO. Der Nutzer
(Betreiber des E-Shops) ist der Verantwortliche für diese Daten.
1.2. Diese Bedingungen regeln die gegenseitigen Rechte und Pflichten bei der
Verarbeitung personenbezogener Daten, zu denen der Auftragnehmer im
Rahmen der Erfüllung des mit dem Nutzer geschlossenen Vertrags durch
Zustimmung zu den Allgemeinen Geschäftsbedingungen unter
www.eshop-schnell.com Zugang gewonnen hat.
2. UMFANG DER VERARBEITUNG PERSONENBEZOGENER DATEN
2.1. Der Auftragnehmer verpflichtet sich, für den Nutzer personenbezogene Daten
im Umfang und zum Zweck nach Art. 2.2 - 2.10. dieser Bedingungen im
Verarbeitungsvertrag zu verarbeiten.
2.2. Der Auftragnehmer verpflichtet sich, für den Nutzer die personenbezogenen
Daten der Kunden des Nutzers zu verarbeiten.
2.3. Der Auftragnehmer verpflichtet sich, für den Nutzer die gewonnenen
personenbezogenen Daten im Umfang der üblichen personenbezogenen
Daten zu verarbeiten.
2.4. Der Auftragnehmer wird im Rahmen der automatisierten Verarbeitung die
personenbezogenen Daten in der auf der Hardware des Auftragnehmers
gespeicherten Datenbank speichern, sie schützen, sichern, Backups
anfertigen, sie sortieren und vernichten.
2.5. Der Auftragnehmer erstellt solche Softwareinstrumente, die dem Nutzer die
Erfüllung der Forderungen von Kunden des Nutzers nach Ausübung der
Rechte betroffener Personen gemäß DSGVO erleichtern, insbesondere das
Recht auf Löschung, das Recht auf Information und das Recht auf
Übertragbarkeit der Informationen.
2.6. Die personenbezogenen Daten werden nur auf der Hardware des
Auftragnehmers, seinen eigenen Servern oder jenen von kooperierenden
Partnern gespeichert. Alle personenbezogenen Daten dürfen nur innerhalb
der Europäischen Union gespeichert werden.
2.7. Der Auftragnehmer verpflichtet sich, für den Nutzer die personenbezogenen
Daten zum Zweck des Betriebs des E-Shop-Portals www.eshop-schnell.com
zu verarbeiten.
2.8. Der Auftragnehmer darf die zu verarbeitenden personenbezogenen Daten der
Kunden des Nutzers nicht für den eigenen Bedarf und nicht zu einem anderen
Zweck als der Erfüllung des Vertrags nutzen.
2.9. Der Auftragnehmer verpflichtet sich, für den Nutzer die gewonnenen
personenbezogenen Daten während der Dauer der Vertragsbeziehung und
für weitere 10 Jahre nach Beendigung der Vertragsbeziehung zu verarbeiten.
2.10. Der Nutzer erteilt seine Erlaubnis zur Hinzuziehung folgender kooperierender
Firmen: Monekon s.r.o. (zum Zweck der Verarbeitung der Rechnungsdaten),
The Rocket Science Group (zum Zweck der Zusendung von Newsletters über
den Service Mailchimp.com), Unihost s.r.o. (Verwalter der Server) und
Casablanca INT (Betreiber des Datenzentrums)
3. SCHUTZ DER PERSÖNLICHEN DATEN
3.1. Der Auftragnehmer verpflichtet sich, mit technischen und organisatorischen
Maßnahmen den Schutz und die Sicherung der gespeicherten
personenbezogenen Daten zu gewährleisten, damit es zu keinem unbefugten
Zugang zu diesen personenbezogenen Daten oder zu ihrem Verlust kommen
kann.
3.2. Die getroffenen technischen und organisatorischen Maßnahmen entsprechen
dem Ausmaß des Risikos. Der Auftragnehmer sowie die kooperierenden
Firmen Unihost s.r.o. (Verwalter der Server) und Casablanca INT (Betreiber
des Datenzentrums) gewährleisten mit ihrer Hilfe die Integrität der Daten und
ihren Schutz vor Missbrauch.
3.3. Der Auftragnehmer erklärt, dass der Schutz der personenbezogenen Daten
den internen Sicherheitsvorschriften des Auftragnehmers unterliegt. Diese
bestimmen, dass zu den personenbezogenen Daten nur hierzu befugte
Personen des Auftragnehmers und der kooperierenden Firmen nach Art. 2.10
dieser Bedingungen Zugang haben, welche zur Verschwiegenheit hinsichtlich
der personenbezogenen Daten und der implementierten
Sicherheitsmaßnahmen verpflichtet sind.
3.4. Nach Beendigung der Vertragsbeziehung ist der Auftragnehmer verpflichtet,
alle personenbezogenen Daten zu löschen, sofern er nicht auf der Grundlage
eines besonderes Gesetzes (z. B. für die gesetzlichen Bedürfnisse der
Polizei) zur Speicherung der personenbezogenen Daten verpflichtet ist.
Abschließende Bestimmungen
Jeder hat das Recht, Einspruch gegen die Verarbeitung Ihrer personenbezogenen Daten für
Zwecke des Direktmarketings zu erheben. Dies gilt auch für das Profiling, sofern das
Profiling dieses Direktmarketing betrifft. Sofern Sie Einspruch gegen die Verarbeitung Ihrer
personenbezogen Daten für Zwecke des Direktmarketings erheben, werden diese
personenbezogenen Daten nicht weiter für diese Zwecke verarbeitet.
Der Nutzer verpflichtet sich, unverzüglich alle ihm bekannten Informationen mitzuteilen, die
eine negative Auswirkung auf die ordnungsgemäße und fristgerechte Erfüllung der aus
diesen Bedingungen hervorgehenden Pflichten haben könnten.
Der Nutzer erklärt sich mit diesen Bedingungen einverstanden, indem er im Internetformular
auf der Website www.eshop-schnell.com die entsprechende Zustimmung ankreuzt.
Alle sonstigen Beziehungen, die nicht ausdrücklich in diesen Bedingungen behandelt
werden, unterliegen der DSGVO und der Rechtsordnung der Tschechischen Republik in der
geltenden Fassung.
Diese Bedingungen sind wirksam ab dem 23.April 2018.
